HISTORY

Ms. Currie graduated on the President's roll of Scholars with her B.A. She obtained her LL.B. in 1986 and has been representing litigants in groundbreaking cases since her call to the bar. Ms. Currie is known both for her advocacy, strength and experience in the Courtroom and advice she renders to clients to avoid costly courtroom battles. She is an instructor at York University, Osgood Law School where she teaches both lawyers and law students trial advocacy and courtroom skills. She is also engaged as an instructor at the Canadian Intensive Trial Advocacy Workshop, which is a course for lawyers wanting to learn trial skills, and is held on an annual basis.

HIGHLIGHTS OF EXPERIENCE

Business and Commercial Law

  • Representation of both companies and employees in employment issues involving employment agreements, termination and wrongful dismissal
  • Ongoing advise and assistance to Boards of Directors in matters concerning business decisions and liability
  • Experience in analyzing and reviewing contracts of a commercial nature with clients to assess their protection prior to signing
  • Drafting of partnership and business agreemen
  • She was engaged in the representation of a major tobacco company on product liability claims and complex litigation arising from the use of tobacco
  • She was one of the team of lawyers on behalf of Canadian tobacco companies who launched a successful constitutional challenge in Quebec involving advertising of the product and constitutional issues
  • Retained by the manufacturer of an airplane on product liability and litigation matters and concerns
  • She was retained by an American heart valve manufacturer with respect to Canadian product liability claims

Administrative Law

  • Chosen by the Honourable Fred Kaufman CMQC (former Court of Appeal Justice) to be his associate Commission Counsel in the Royal Commission in the Proceedings involving Guy Paul Morin
  • Represented numerous individuals and companies before Tribunals, Disciplinary bodies, Inquests, Human Rights Commissions and Royal Commissions
  • Co-counsel on behalf of the Canadian Red Cross in the Krever Royal Commission of Inquiry into the safety of the Blood System and Aids
  • Retained on behalf of physicians and other professionals before their disciplinary tribunals and hearings and appeals
  • Consent and Capacity Review Board involving issues of treatment, capacity, involuntary hospitalization and the Community Treatment Legislation

Inquests

  • Numerous inquests investigating the circumstances of inmates dying while in custody
  • Representation of a Group Home worker engaged in a restraint resulting in the death of a resident
  • Representation of a psychiatrist in an inquest involving allegations surrounding the provision of psychiatric medication involved in a young boy's death from neuroleptic malignant syndrome
  • Representation of a physician investigating the propriety of medication prescribed preceding the death of a patient
  • Representation of Children's Aid during a lengthy inquest reviewing the circumstances of a child being strangled in a car seat

Civil Litigation

Ms. Currie has represented both plaintiffs and defendants in many areas of complex litigation including:

  • Representation of a bank in a complex fraud litigation trial
  • The defense of individuals in cases involving allegations of malpractice
  • The representation of plaintiffs when injured by negligent professionals
  • Defense of Group Homes in cases of allegations of wrongful dismissal and negligence
  • Representation of executives wrongfully terminated from their employment
  • Representation of various Municipalities in actions involving environmental claims, fire loss, and negligence
  • Representation of numerous Children Aid Societies involving allegations related to injury, abuse, sexual assault or death to children under their case
  • She has been engaged in the representation of various Group Homes in cases involving allegations of abuse, sexual assault, improper restraint and negligence resulting in death and personal injury
  • Litigation involving penal institutions in cases of allegations of sexual assault, abuse, negligence or assault

Criminal Law

  • Criminal prosecutions and defense representation
  • In 1993 Ms. Currie was seconded for the year to the Crown Attorney's office where she prosecuted a wide variety of criminal cases
  • Criminal defense counsel to represent defendants in a number of cases
  • Appointed Associate Commission Counsel into the Royal Commission involving the wrongful conviction of Guy Paul Morin (of the murder of Christine Jessop). The work in these proceedings involved a detailed analysis of the criminal justice system culminating in a report that has had far reaching impact on issues governing criminal law and procedure.
